1. Platform Definition
Moment of Vibe ("MoV," "the Platform," "we," "us") is a Vibe Bonding Intelligence Platform (VBIP) — a voice-first, AI-mediated human connection system that enables users to create voice-based relational identities, engage in AI-guided conversations, receive real-time emotional and behavioral intelligence, and progressively build meaningful connections across romantic, social, and shared-interest contexts.
MoV is not a passive tool. It is a continuously active relational system that listens, analyzes, and responds to the emotional and conversational dynamics between human users in real time. By registering and using the Platform, you acknowledge that you are engaging with an AI-native, voice-primary relational infrastructure — not a traditional messaging or profile-browsing service.
MoV Is
1. A Vibe Bonding Intelligence Platform (VBIP) 2. A voice-first relational intelligence system 3. An AI-mediated human connection platform 4. An emotional and behavioral modeling environment 5. A multi-AI orchestrated bonding infrastructure 6. A consent-first emotional technology layer
MoV Is Not
1. A dating application or social media platform 2. A passive content or entertainment service 3. A mental health, therapy, or medical platform 4. A guaranteed matchmaking or relationship service 5. A surveillance system or data-monetization tool 6. A communication tool operating without AI involvement
1.2 Platform Philosophy. MoV is designed and operated on the foundational principle that human connection is emotional, relational, and deeply contextual — and that technology must serve connection outcomes rather than engagement metrics. Every feature, AI component, and policy within this Platform is architected to prioritize bonding depth over interaction volume, emotional safety over speed, and relational outcomes over platform dependency. This orientation shapes how the Platform is governed, how user data is handled, and how liability is apportioned between the Platform and its users.
1.3 Relational Infrastructure Status. MoV operates as relational infrastructure — a technology layer that provides the architecture, intelligence, and environment for human connection to occur. As with any infrastructure, MoV facilitates but does not determine the outcomes of interactions. The Platform is not a party to, nor a guarantor of, any relationship, emotional state, or interpersonal outcome that emerges through its use.
User Acknowledgment: By accessing or using MoV, you acknowledge that you are engaging with an AI-native relational platform that actively processes voice, emotional signals, and behavioral patterns as a core function of its service delivery. This is not incidental — it is the foundational mechanism of the Platform's value.
2. Eligibility & Access
2.1 Age Requirement. Use of MoV is strictly restricted to individuals who are 18 years of age or older at the time of registration and at all times during their use of the Platform. This restriction is absolute. MoV does not knowingly permit or enable access by any person under the age of 18. Any registration made by a person under this age threshold is void and unauthorized. MoV reserves the right to use voice biometric signals, behavioral patterns, and device-level signals to detect potential age misrepresentation, and to immediately suspend or permanently terminate any account where such misrepresentation is detected or reasonably suspected. Users who are aware of underage access are required to report this through the Platform's safety reporting mechanism.
2.2 Identity Authenticity Requirement. Each MoV account must represent a single, real human individual. The creation of fictitious personas, aggregated profiles representing groups, bot-operated accounts, or any form of non-human identity expression is strictly prohibited and constitutes a material breach of these Terms. Users represent and warrant that all information provided at registration and throughout their use of the Platform — including voice profile inputs, biographical data, stated intentions, and communication during interactions — is truthful, current, and accurately represents their actual identity, character, and relational intentions.
2.3 Consent to AI-Mediated Interaction. A fundamental eligibility condition for using MoV is the user's informed, affirmative, and ongoing consent to engage within an AI-mediated environment. This means: 1. Users understand and accept that AI systems actively observe, analyze, and respond to voice inputs, emotional signals, and conversational dynamics during and after interactions. 2. Users accept that AI-generated nudges, suggestions, and insights are integral to the service and may be delivered in real time during voice conversations. 3. Users understand that their voice inputs are processed to generate a dynamic Human-Connect Profile (HCP) that informs compatibility modeling, mediation, and bonding intelligence. 4. Users accept that AI analysis of their interactions is performed continuously as a core product function, not as an optional feature.
2.4 Jurisdictional Compliance. Users are solely responsible for ensuring that their use of MoV complies with all applicable laws, regulations, and restrictions in their jurisdiction of residence or access. MoV does not guarantee that the Platform is lawful or available in all jurisdictions. Where local law prohibits or restricts voice data processing, AI-mediated communication, or any other core function of the Platform, users must not access or use MoV.
2.5 Verification Rights & Enforcement. MoV reserves the right to verify eligibility at any point using the following mechanisms, individually or in combination: 1. Voice biometric verification: Analysis of vocal characteristics to confirm identity consistency across sessions and detect impersonation or account sharing. 2. Behavioral verification: Assessment of interaction patterns, response consistency, and communication coherence to identify automated, fraudulent, or multi-account behavior. 3. Device signal analysis: Evaluation of device identifiers, access patterns, and session metadata to detect coordinated inauthentic behavior or policy violations. 4. Government ID verification (Premium Plus tier): Optional enhanced verification layer for users who elect entry into the verified-only discovery pool. Failure to satisfy verification requirements, or provision of false information during verification, constitutes grounds for immediate account suspension or permanent termination without notice.
User Acknowledgment — Eligibility
By completing registration, you represent and warrant that: (a) you are at least 18 years of age; (b) you are a single, real human individual registering on your own behalf; (c) you consent to AI-mediated interaction as a core element of the service; (d) your use of MoV complies with all laws applicable to you; and (e) all information you have provided is truthful and accurate.
3. User Responsibilities
3.1 Authentic Interaction. Users bear primary responsibility for the authenticity and integrity of their presence on the Platform. Authentic interaction is not merely encouraged — it is a structural requirement of the MoV system, as the Platform's AI components are calibrated to read, interpret, and respond to genuine human expression. Deliberate misrepresentation distorts the relational environment for other users and degrades the accuracy of AI-generated intelligence across the Platform. 1. Users must provide truthful, spontaneous, and self-representative voice responses during profiling, onboarding, and all conversation interactions. 2. Users must not rehearse, script, or otherwise artificially construct voice inputs intended to deceive AI systems or other users regarding their true personality, values, or intentions. 3. Users must not impersonate any other person — living or deceased — or misrepresent any material characteristic of their identity. 4. Users must not use voice-altering software, AI-generated voice, or any technology designed to mask, modify, or fabricate their vocal characteristics.
3.2 Respectful Communication. All interaction on MoV — whether in voice conversations, text exchanges, or any other communication channel provided by the Platform — must be conducted with respect for the dignity, emotional safety, and wellbeing of all participants. The following are prohibited without exception: 1. Verbal abuse, threats, intimidation, or harassment of any kind, including language designed to degrade, humiliate, or cause emotional harm. 2. Discriminatory, hateful, or dehumanizing language based on gender, race, ethnicity, religion, sexual orientation, disability, or any other protected characteristic. 3. Sexual coercion, manipulation, or solicitation — including implicit pressure tactics, boundary violations, or repeated unwanted advances following clear rejection. 4. Gaslighting, psychological manipulation, or deliberate emotional destabilization of other users. 5. Use of AI-provided nudges or mediation outputs to manipulate, deceive, or exploit other users. MoV's AI systems are designed to detect behavioral patterns consistent with the above violations. Detection may result in automated protective actions, escalation to human review, or immediate account suspension.
3.3 Consent-Based Engagement. Consent is the foundational currency of all interaction on MoV. Users are required to treat every conversation as a shared emotional environment in which the boundaries and comfort levels of all participants are equally valid and equally protected. 1. Users must not pressure, rush, or manipulate other users into interactions, disclosures, or relationship escalations that have not been mutually and freely agreed upon. 2. Users acknowledge that MoV's Emotional Intelligence Engine may detect discomfort signals, withdrawal cues, or boundary-resistance in real time, and that the Platform may intervene to protect the affected user. 3. Users must respect the boundaries communicated — explicitly or implicitly — by other users during conversations, even when AI nudges have been used to guide the interaction. 4. Users must not interpret AI mediation outputs, compatibility scores, or motive alignment indicators as entitlement to another user's engagement, attention, or affection.
Responsibility Principle: MoV provides the infrastructure, intelligence, and environment for human connection. The quality of that connection — the respect, honesty, and care with which it is pursued — remains entirely the responsibility of each individual user.
4. AI-Mediated Interaction Framework
4.1 The Multi-AI Architecture. MoV's core functionality is delivered through a coordinated multi-agent AI architecture comprising four specialized intelligence systems. Each system operates within a defined scope and function. By using the Platform, users acknowledge and consent to interaction with all four systems as an integrated, inseparable element of the service:
Probe Engine
Identity & Emotional Modeling
Analyzes voice inputs to construct and continuously update the user's Human-Connect Profile (HCP) — including personality structures, emotional signatures, communication patterns, and relational motives.
Mediator Engine
Real-Time Conversation Guidance
Operates during live voice interactions to guide conversational flow, detect tension and discomfort, suggest shared anchors, and protect emotional safety — all without interrupting the natural rhythm of interaction.
Counsel Engine
Post-Interaction Intelligence
Generates post-call insights, emotional resonance summaries, compatibility analysis, bonding trajectory indicators, and communication coaching feedback based on longitudinal interaction data.
Gratification Engine
Healthy Behavioral Reinforcement
Recognizes and reinforces positive relational behaviors — mutual effort, emotional openness, consistency — through milestone acknowledgments and connection-positive feedback patterns.
4.2 What AI Analyzes. Users explicitly consent to the following forms of AI analysis as integral to the Platform's service delivery: 1. Voice tone and prosody: Pitch, pacing, rhythm, warmth, confidence, tension, and emotional variability extracted from voice signals. 2. Emotional signals: Comfort levels, anxiety markers, excitement, curiosity, attraction indicators, and reciprocity patterns identified through multimodal voice and language analysis. 3. Conversation dynamics: Talk-time balance, topic resonance, silence patterns, conversational flow, pacing synchrony, and shared meaning formation. 4. Motive indicators: Signals aligned with the 24-Motive Intent Model — detecting relational intent and identifying alignment or misalignment between users' underlying connection motives. 5. Longitudinal relational patterns: Changes in emotional tone, bonding trajectories, trust development, and reciprocity across multiple interactions over time.
4.3 What AI Provides. AI outputs are delivered to users in the following forms, all of which are designed to be supportive and non-intrusive: 1. Real-time nudges: Discreet, private conversational suggestions delivered during voice calls — topic ideas, pacing adjustments, tension-diffusion cues, and positive alignment signals. 2. Behavioral suggestions: Context-aware guidance calibrated to the current emotional state, motive alignment, and conversation dynamics of a given interaction. 3. Insight reports: Post-interaction summaries including emotional resonance scores, comfort indexes, reciprocity ratios, bonding probability curves, and communication quality indicators. 4. HCP updates: Progressive refinements to the user's Human-Connect Profile based on accumulated interaction data, improving the accuracy of future matching and mediation.
System Transparency Clause — AI Responsibility Boundaries: All AI outputs generated by MoV's systems are assistive and informational in nature only. They are not authoritative decisions, clinical diagnoses, psychological assessments, therapeutic recommendations, medical opinions, or legal guidance. AI suggestions are tools to enhance human awareness and communication quality — not directives, instructions, or determinations of any kind. MoV's AI systems do not make decisions for users. They illuminate options. The responsibility for all interaction decisions rests entirely with the human participants.
4.4 AI Transparency & User Control. MoV is committed to transparent AI operation. Users retain the following rights with respect to AI interaction throughout their use of the Platform: 1. The right to understand, at any time, what categories of data are being analyzed and for what purpose. 2. The right to adjust their mediation preference level — from minimal AI intervention to full mediation support — within Platform settings. 3. The right to accept or ignore any AI-generated nudge or suggestion during or after an interaction without penalty. 4. The right to opt out of specific categories of emotional analysis, subject to the baseline processing required for safety and compliance functions.
5. Voice-First Identity System
5.1 Voice as Primary Identity Layer. MoV is architected around voice as the primary signal of human identity, personality, and relational character. Unlike platforms that rely on photographs, written bios, or categorical preference data, MoV derives its understanding of who a user is from the richest signal available in digital interaction: the human voice. By using MoV, users recognize and accept that their voice — not a photograph, not a profile description — is the foundational layer of their identity on the Platform. Voice carries emotional truth, psychological patterns, communication character, and relational intent in a form that is both deeply human and scientifically interpretable by MoV's AI systems.
5.2 Human-Connect Profile (HCP). The Human-Connect Profile (HCP) is MoV's dynamic, AI-constructed representation of each user's psychological, emotional, and relational identity. The HCP is not a static record — it is a living model that evolves with each interaction, voice input, and behavioral signal the user contributes to the Platform. The HCP is constructed across twelve interdependent dimensions, including but not limited to: personality structure, communication style, emotional signature, relational architecture, values and worldview, social energy, intent and motive scoring, attachment tendency, trust patterns, bonding style, conflict behavior, and longitudinal stability indicators. Users acknowledge that their HCP represents MoV's AI interpretation of their relational identity based on available voice and behavioral data — not a definitive or clinically validated psychological profile.
5.3 Permitted Uses of Voice Data. Voice inputs collected through the Platform are processed and used exclusively for the following Platform-defined purposes: 1. Construction and dynamic updating of the user's Human-Connect Profile (HCP) and Vibe Graph. 2. Real-time emotional and behavioral analysis during voice interactions to power Mediator Engine outputs. 3. Compatibility computation and matching intelligence generation. 4. Post-interaction insight generation via the Counsel Engine. 5. Identity integrity verification, fraud detection, and platform safety operations. 6. Longitudinal bonding and relational trajectory modeling for Couples+ development features. 7. Platform improvement and AI model refinement using appropriately anonymized and aggregated voice features — never raw audio. Voice data is never sold, licensed to third parties for commercial purposes, used for advertising targeting, or shared with external entities except as required by law or expressly authorized by the user.
5.4 Voice Data Handling & Retention. MoV applies a data minimization principle to all voice processing operations. Raw audio recordings are processed and reduced to interpreted features as rapidly as technically feasible. The following data handling framework applies: 1. Raw audio storage: Retained for a maximum of 24–48 hours following processing completion, solely for quality assurance and error correction purposes, then permanently deleted. 2. Derived voice features: Processed voice characteristics (prosodic features, emotional signal scores, embeddings) retained as part of the user's HCP for the duration of their account, subject to user deletion rights. 3. Transcript data: Stored in encrypted form and subject to user-configurable retention periods, with a platform default not exceeding 90 days unless the user explicitly opts for extended retention. 4. Upon account deletion: All voice-derived data is permanently and irreversibly deleted within 30 days of account closure, with cryptographic verification of deletion upon request.
User Acknowledgment — Voice Identity
By contributing voice inputs to MoV, you acknowledge that your voice is processed by AI systems to construct and maintain your Human-Connect Profile; that this processing is core to the Platform's service and not optional; that all voice processing is conducted under explicit consent which you may withdraw at the cost of service access; and that raw audio is not retained beyond a 48-hour processing window.
6. Matching & Compatibility
6.1 Multi-Dimensional Compatibility Model. MoV's matching system evaluates compatibility across eight interdependent dimensions: emotional resonance, psychological alignment, communication style fit, motive alignment (via the 24-Motive Intent Model), social energy compatibility, attachment interplay, lifestyle and practical alignment, and bonding probability curve. This multi-dimensional approach is designed to surface connections with genuine relational potential — not superficial categorical similarity. Compatibility scores are computed dynamically and updated as each user's HCP evolves through ongoing interaction. A compatibility score generated early in a user's lifecycle on the Platform may differ meaningfully from one generated after several months of deeper profiling.
6.2 Nature of Compatibility Scores. Compatibility scores, synergy percentages, and all related metrics generated by MoV's Compatibility Engine are probabilistic AI interpretations — not mathematical certainties, psychological determinations, or relationship guarantees. Users are required to treat these outputs as informed indicators to support their own judgment, not as authoritative assessments of relational potential. Compatibility is a dynamic human phenomenon. MoV's AI can model many of its dimensions with meaningful accuracy, but it cannot account for every element of human chemistry, personal growth, life circumstance, or the inherently unpredictable nature of human connection. Users must apply their own discernment to all matching intelligence the Platform provides.
6.3 Disclaimers — Matching Outcomes. MoV makes no representation, warranty, or guarantee of any kind with respect to the following: 1. That any match will result in a conversation, friendship, romantic relationship, or any other relational outcome. 2. That compatibility scores accurately predict the quality, durability, or emotional character of any specific relationship. 3. That the Platform will identify a compatible match for every user within any defined timeframe. 4. That motive alignment detected by the 24-Motive Intent Model reflects the complete, conscious, or fixed motivations of any other user. 5. That high compatibility scores guarantee emotional safety, mutual attraction, or successful bonding.
6.4 Motive Alignment & Intent Modeling. The 24-Motive Intent Model is designed to help users understand the relational context in which connections are forming — not to bind users to stated or detected motives. Human motivations evolve. MoV's intent model tracks this evolution dynamically and adapts compatibility and mediation intelligence accordingly. Users may not hold MoV liable for interactions in which detected motive alignment did not reflect the ultimate relational intentions of another user.
7. Real-Time AI Mediation
7.1 Nature of Real-Time Mediation. During live voice interactions on MoV, the Mediator Engine operates as an active, continuous intelligence layer — monitoring conversational dynamics, emotional signals, motive alignment, and pacing in real time. This is not a passive background process; it is the defining characteristic of MoV as a mediated connection platform. Mediation operates privately for each user — meaning AI guidance is delivered discretely to individuals, not broadcast into the shared conversation space. Each participant may receive different, context-specific guidance calibrated to their individual emotional state and conversational experience.
7.2 Forms of Mediation Intervention. Mediation outputs may include any or all of the following, depending on conversational context and user settings: 1. Topic suggestions: Shared interest anchors or conversation pathways identified as emotionally resonant for both participants. 2. Pacing guidance: Cues to allow space, accelerate engagement, or rebalance talk-time reciprocity. 3. Tension detection alerts: Private notifications to individual users when elevated stress, discomfort, or misalignment signals are detected in the conversation. 4. Comfort reinforcement: Positive acknowledgment when strong emotional resonance, curiosity, or shared meaning is detected. 5. Safety escalation: In cases where discomfort, coercion, or boundary violation signals are detected, the Platform may take protective action without user initiation — including optional session termination tools or access to safety resources.
7.3 User Control Over Mediation. Users retain meaningful control over their mediation experience within the Platform's safety constraints: 1. Users may configure their mediation preference level (minimal, standard, or full) through Platform settings at any time. 2. Users may accept or ignore any individual AI nudge without consequence to the underlying interaction or their HCP. 3. Users may disable non-safety mediation entirely, though core safety monitoring — discomfort detection, boundary violation alerting — remains operational at all times to protect all Platform participants.
7.4 Liability — Mediation Outcomes. MoV's real-time mediation is designed to improve the quality, safety, and emotional flow of interactions. However, mediation is inherently advisory. Users retain full autonomy over their conversational decisions. MoV is not liable for: 1. Decisions made by users in response to, or in disregard of, AI-generated nudges or suggestions. 2. Conversational outcomes — positive or negative — that occur despite or following mediation intervention. 3. Emotional consequences arising from interactions in which mediation was available but ignored by one or both parties. 4. Technical limitations of AI interpretation that result in mediation that is contextually imprecise, delayed, or absent.
8. Content & Conduct Policy
8.1 Prohibited Conduct — Absolute Prohibitions. The following conduct is prohibited on MoV in all circumstances, without exception, and without any requirement for intent to be established. Violation of any absolute prohibition constitutes grounds for immediate and permanent account termination: 1. Sexual exploitation, abuse, or solicitation of any kind, including unsolicited sexual communication and any conduct involving or directed at minors. 2. Threats of physical harm, violence, or death directed at any person, whether on or off the Platform. 3. Deliberate distribution of another user's private or intimate material without consent. 4. Creation or use of accounts by persons under 18 years of age. 5. Systematic impersonation, fraudulent identity construction, or operation of non-human accounts.
8.2 Prohibited Conduct — Behavioral Violations. The following conduct is prohibited and subject to a graduated enforcement response ranging from warning to permanent termination, depending on severity and recurrence: 1. Harassment, sustained verbal abuse, or coordinated pressure campaigns targeting any user. 2. Hate speech, discriminatory language, or dehumanizing content directed at any individual or group. 3. Psychological manipulation, gaslighting, emotional exploitation, or coercion. 4. Misrepresentation of identity, intentions, or material personal characteristics in a manner designed to mislead other users. 5. Unauthorized extraction, recording, or redistribution of other users' voice, conversation content, or profile data. 6. Deliberate exploitation or abuse of AI-generated insights — including using compatibility or motive data to manipulate, deceive, or pressure other users.
8.3 Platform Enforcement Rights. MoV reserves the right to take any of the following actions in response to conduct violations, at its sole discretion and without prior notice where circumstances require immediate protective action: 1. Issuing formal written warnings through the Platform notification system. 2. Temporarily suspending account access, including access to active matches and ongoing conversations. 3. Permanently banning accounts and all associated device and network identifiers. 4. Removing specific content, voice data, or profile elements that violate this policy. 5. Reporting conduct to relevant law enforcement or regulatory authorities where legally required or warranted by the nature of the violation. 6. Cooperating with law enforcement investigations by disclosing user data to the extent required by applicable law.
8.4 AI Monitoring Framework. MoV uses automated AI systems — including real-time voice analysis, behavioral pattern modeling, and content safety classifiers — to detect conduct violations continuously across the Platform. Users acknowledge and accept this monitoring as a structural safety mechanism integral to the Platform's design. This monitoring is conducted under the user's express consent provided at registration and does not constitute surveillance in the legally actionable sense; it is a contractually agreed platform safety function.
9. Data Usage Consent
9.1 Categories of Data Processed. By registering and using MoV, users provide explicit, informed consent to the processing of the following categories of personal data for the stated purposes: 1. Voice recordings and derived acoustic features: Processed for HCP construction, emotional analysis, identity verification, and mediation intelligence generation. 2. Conversation transcripts: Processed for motive modeling, compatibility scoring, Counsel Engine insights, and safety monitoring. 3. Behavioral interaction data: Call duration, reciprocity metrics, topic engagement, session frequency, and platform navigation patterns processed for AI model refinement and matching intelligence. 4. Emotional and psychological inferences: AI-generated interpretations of emotional states, attachment tendencies, communication styles, and relational motives derived from voice and behavioral data. 5. Device and access metadata: Device identifiers, IP addresses, session timestamps, and access patterns processed for security, fraud prevention, and service delivery.
9.2 Consent Characteristics. Data processing consent on MoV has the following characteristics, which are non-negotiable elements of the Platform's operational framework:
Explicit
Consent is not implied by platform use alone. At registration and at each new category of processing introduced by the Platform, users are presented with clear, specific consent flows that must be affirmatively completed before processing commences.
Granular
Users may consent to different categories of processing independently where technically feasible. Core safety processing — voice identity verification, discomfort detection, conduct monitoring — cannot be independently disabled without terminating Platform access, as it protects all users in the shared environment.
Revocable
Users may withdraw consent to non-essential processing categories at any time through Platform privacy settings. Revocation of consent to core processing categories required for service delivery will result in loss of access to associated features and may require account closure.
9.3 Special Category Data — Emotional & Behavioral Inferences. MoV recognizes that emotional state inferences, psychological pattern modeling, and behavioral profiling derived from voice analysis may constitute sensitive data under applicable privacy law frameworks, including India's Digital Personal Data Protection Act 2023 and the European Union's General Data Protection Regulation. Such data is processed exclusively on the basis of explicit user consent and is subject to heightened protection standards within MoV's data infrastructure, including encryption at rest, strict access controls, and automated retention limits.
9.4 What MoV Does Not Do With User Data. 1. Sell, rent, or license user data — including voice data, HCP attributes, or emotional inferences — to third parties for any commercial purpose. 2. Use user data for advertising targeting, programmatic ad delivery, or commercial profiling for any entity other than MoV itself. 3. Share raw voice recordings with any third party except where technically required for speech processing (under strict data processing agreements) or compelled by law. 4. Use emotional intelligence outputs to discriminate against users in ways unrelated to platform safety or legitimate relational compatibility functions.
10. Limitation of Liability
Core Principle: MoV provides tools, intelligence, and infrastructure for human connection. It does not provide guarantees of any outcome, emotional state, or relational result. The distance between facilitation and guarantee is the full extent of MoV's liability boundary.
10.1 Exclusions of Liability. To the maximum extent permitted by applicable law, MoV and its officers, directors, shareholders, employees, agents, contractors, AI systems, and technology partners shall not be liable for: 1. Emotional outcomes: Any emotional harm, distress, disappointment, attachment injury, or psychological consequence arising from interactions, matches, AI outputs, or Platform experiences of any kind. 2. Relationship success or failure: Any outcome — positive or negative — in any relationship, romantic connection, friendship, or other interpersonal bond that originates on or is supported by the Platform. 3. User behavior: Any act, statement, omission, misrepresentation, or harm perpetrated by one user against another, regardless of whether such conduct occurred within the Platform environment. 4. AI misinterpretation: Errors, inaccuracies, or limitations in AI-generated outputs — including compatibility scores, emotional analyses, motive alignment assessments, or mediation nudges — that result in suboptimal interactions or decisions by users. 5. Reliance on AI outputs: Any decision made by a user in reliance on any AI-generated insight, compatibility score, or Platform recommendation that produces an undesired outcome. 6. Third-party services: Actions, failures, or outputs of any third-party service provider integrated with the Platform, including voice infrastructure providers, payment processors, or notification services. 7. Force majeure: Any failure of service resulting from events outside the Platform's reasonable control, including infrastructure outages, regulatory actions, natural events, or cyber incidents.
10.2 Aggregate Liability Cap. Where liability cannot be fully excluded under applicable law, MoV's total aggregate liability to any individual user for all claims arising from or relating to use of the Platform — regardless of the form of action or the theory of liability — shall not exceed the greater of: (a) the total subscription fees paid by that user to MoV in the twelve months preceding the claim; or (b) INR 1,000 (one thousand Indian Rupees) or its equivalent in the user's local currency.
10.3 No Liability for AI Advisory Limitations. MoV's AI systems operate at the frontier of voice-based emotional and relational intelligence. Users expressly acknowledge that no AI system — however sophisticated — can perfectly model the full complexity of human psychology, emotion, or relational behavior. Limitations in AI interpretation are a known and accepted characteristic of the Platform's technology, not a defect in service delivery. MoV's continuous investment in improving AI accuracy does not create liability for current system limitations.
11. Termination
11.1 Grounds for Platform-Initiated Termination. MoV reserves the right to suspend or permanently terminate any user account — with or without prior notice, at its sole discretion — on any of the following grounds: 1. Violation of any provision of these Terms & Conditions, the Privacy Policy, the Community Guidelines, or the Responsible AI Policy. 2. Conduct harmful to other users, including harassment, abuse, manipulation, deception, or sexual misconduct. 3. Identity fraud, impersonation, account sharing, or creation of unauthorized multiple accounts. 4. Age misrepresentation or use of the Platform by any person under 18. 5. Use of the Platform for commercial purposes, data harvesting, or automated access without authorization. 6. Any conduct that in MoV's reasonable judgment undermines the safety, integrity, or emotional health of the Platform community.
11.2 User-Initiated Account Closure. Users may close their MoV account at any time through the account settings interface. Account closure initiates the following data lifecycle sequence: 1. Active matching and conversation access terminates immediately upon closure confirmation. 2. The user's profile is removed from discovery within 24 hours of closure. 3. All personally identifiable voice data, transcript data, and HCP attributes are permanently deleted within 30 days of account closure. 4. Aggregated, anonymized data derived from the user's interactions — from which the individual cannot be re-identified — may be retained for AI model improvement purposes. 5. Subscription billing is cancelled from the next billing cycle; no pro-rata refunds are issued for unused subscription periods unless required by applicable consumer law in the user's jurisdiction.
11.3 Right to Data Deletion. Users have the right to request complete deletion of all personal data held by MoV, independent of account closure. Data deletion requests must be submitted through the formal privacy request channel available within the Platform's settings. Upon verification of the request, MoV will complete deletion within the timeframes required by applicable privacy law — not to exceed 30 days — and will provide confirmation of deletion upon completion.
11.4 Post-Termination Obligations. Termination of a user's account does not affect any obligation, representation, warranty, or liability that arose prior to the date of termination. Provisions of these Terms that by their nature survive termination — including limitations of liability, data handling commitments, and governing law — shall continue in full force following account closure.
12. Governing Principle
12.1 The Foundational Commitment. Every legal provision in this document, every data handling commitment, every AI design decision, and every platform policy exists in service of a single governing principle:
Governing Principle — Moment of Vibe
Outcome over Engagement. Connection over Consumption.
MoV exists to make human connection deeper, safer, and more meaningful — not to maximize time spent on the Platform.
12.2 Legal Architecture as Mission Alignment. MoV's business model is designed to succeed when its users form genuine connections — and to lose value when they do not. This alignment is not incidental. It is architecturally enforced: MoV monetizes emotional intelligence, relational guidance, and bonding depth — not swiping volume, profile views, or addictive re-engagement loops. These Terms & Conditions reflect that alignment. They protect users from the Platform's own potential to cause harm, not merely from each other. They define the boundaries of AI involvement with clarity and honesty. They ground liability in the genuine capabilities of a facilitation system, not in the aspirational language of a relationship guarantee.
12.3 The 2 AM Standard. Every interface element, policy decision, and AI behavior on MoV is evaluated against what we internally call the 2 AM Standard: does this feel safe, honest, and supportive to a person in a vulnerable emotional moment? This standard governs product design, data handling, AI training, and — by extension — these Terms. Users engaging with MoV at their most emotionally available moments deserve a platform that holds that vulnerability with integrity.
12.4 Future Amendments. MoV reserves the right to amend these Terms & Conditions to reflect product evolution, regulatory changes, or improvements to platform safety and user protection. Material amendments will be communicated to registered users with a minimum of 14 days' notice prior to effectiveness, and users will be required to affirmatively accept material changes before continued access to the Platform. Continued use of MoV following the effective date of any amendment constitutes acceptance of the revised Terms.
Closing Statement: Moment of Vibe is building the infrastructure for a healthier, more emotionally intelligent era of digital human connection. These Terms are not merely legal protection — they are the legal expression of that commitment. Every clause exists because real people, in real emotional moments, deserve a platform that takes their wellbeing as seriously as their engagement.
